Avenbury Lakes is an age-restrictive community.  The corporation documents allow for a Senior Housing Exemption from the Federal Fair Housing Act, allowing the population of the community to be primarily 55 years of age and older or 80% of the total residency, and up to 20% of the residents can be between 18 to 55 years of age.  The law requires an update of this age information every two years.  No resident can live in the community who is under 18.  A resident is defined as anyone residing here for more than thirty (30) days. Per Federal requirements, not only are residents asked every two years to verify the ages of all residents in their homes, they are also required to disclose this requirement to potential purchasers of the residence and interested real estate agents.  Also, if there is a change of residency status in your home, you must report the change to the business office immediately. Changes include an occupant moving into your home who will be residing for more than thirty (30) days, such as a college student returning home for the summer, a relative moving in for short or long term health care, the death of a resident, or a son/daughter moving in while their home is being built, etc.  Changes must be reported to the business office and proper documentation approved by the Board of Directors before residency can be established. The data base serves as the basis for mailings, Lodge swipe card issuance, directory information, as well as meeting the requirements of federal compliance.  At present, Avenbury Lakes has a total of 543 residents,  5.71% or 31 residents are between the ages of 18 and 54.  This gives a margin of 14.29% or 77 residents who could be added to continue to be in compliance with requirements for an age restrictive community.  This number changes, of course, as the total population increases or decreases. 

In an extreme hardship or crisis situation, an Owner may appeal to the Board of Directors for a short exception to this rule.  Each request is considered individually and with the data information available at that particular time.
